Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Shard ("the App"), you agree to be bound by these Terms of Service ("Terms"). The App is provided by Senyu Limited Network Technology Co., Ltd ("we", "us", or "our"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Shard provides AI-powered antique identification and valuation services. The App allows users to photograph antiques and receive identification, market pricing, historical information, and rarity assessment.

3. AI-Generated Content Disclaimer

Important: Shard's identifications, valuations, and assessments are generated by artificial intelligence and should be considered informational estimates only. They do not constitute professional appraisals. We recommend consulting a certified appraiser for high-value items or insurance purposes.

While our AI verifies findings against real market data and auction records, results may vary in accuracy. Shard is not liable for decisions made based on AI-generated assessments.

4. Subscriptions & Billing

  • Free Tier: Core identification features including reference pricing, rarity classification, value insights, basic info, market references, and chat tools are available at no cost.
  • Premium Subscription: Available as monthly or annual plans. New subscribers receive a 3-day free trial. Subscription pricing is displayed in the App at the time of purchase and may vary by region.
  • Free Trial: If you start a free trial, you will not be charged until the trial period ends. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the displayed subscription price.
  • Billing: Subscriptions are managed and billed through Apple's App Store. Payment is charged to your Apple ID account upon confirmation of purchase or at the end of the free trial period.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription price.
  • Cancellation: You may manage or cancel your subscription at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer or extract the AI models
  • Submit inappropriate, offensive, or illegal content
  • Interfere with or disrupt the App's services or servers
  • Use the App to facilitate the sale of stolen or illicitly obtained items

6. Intellectual Property

The App, including its design, code, AI models, and content, is owned by Senyu Limited Network Technology Co., Ltd and protected by intellectual property laws. You retain ownership of photos you submit but grant us a limited, non-exclusive license to process them solely for the purpose of providing identification services.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Senyu Limited Network Technology Co., Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Senyu Limited Network Technology Co., Ltd and its affiliates, officers, and employees from any claims, losses, or damages (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that identification results will be accurate.

10. Apple-Specific Terms

The following terms apply to your use of the App as downloaded from Apple's App Store:

  • These Terms are between you and Senyu Limited Network Technology Co., Ltd only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • Apple has no obligation to provide any maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims relating to the App, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or on our website. Continued use of the App after changes are posted constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Senyu Limited Network Technology Co., Ltd is registered, without regard to conflict of law principles.
